GotFreedom?11-12 09:09 AMI e-filed my AP and did not send any documents and just received an RFE requesting 2 photographs(write alien number with pencil in the back) and a preferably color photocopy of a photo ID.

So, please make sure that you send those supporting documents with the e file receipt to USCIS. They give out the address and instructions at the end of the application which are easy to follow.

Nevertheless, I e Filed EAD too and did not send any supporting documents and they approved it without issuing any RFE. They used an older picture from my previous EAD.

My 2 paise!!!

So they will ask for at least 3 years of extension. What are the chances that I will get 3 years extension based on existing I140?

1. Some VO cancel your all previous visas when stamping new one. If that happens, of course you can not use any of the previous visas.

2. Some VO are "lazy" to so; if they leave your B1 as it is (and do not cancel it), you can use it in future.

You can not "ask" them to leave your B1 alone (as legally they are required to cancel them). If you raise the questions during stamping, chances are that they "will cancel" it. So best option: Go for stamping and see what happens!

I am a July filer NJ resident and my I-485/EAD/AP were sent to Nebraska and got the AP/EAD approved through Nebraska going by my LIN no. As per the (C)(9) rules it says NJ residents should file to Texas service center and somewhere else I read that my EAD renewal application should be sent to the location where my I-485 is getting processed.

Please share your experiences.

That is why some lawyers say yes, some say no. They don't know what USCIS will say.

I've emailed the ombudsman to get USCIS to answer and give a legal basis for their answer too.

We deserve to know.

rahulpaper06-19 06:15 PMI just came back from doc..and he charged 400 dollars (xray will cost more in next few days. Anyways, he says he need to administer Tetnus 3 times (6 months apart).
I am not sure what he will say in report (which i get in couple of days). But my question to you all is :

When Shots are given with time lag, Is 485 processed normally or RFE happens or do USCIS just wait for all shots to be completed and submission of report by doc before they process anything?

I know this question has been asked in past so many time but I could not find. I have H1b stamp valid till Nov 1st 2008. I got my h1b ext approved till2011. I was not planing to go india this year but because of emergecny I may have to travel with in week. I will be there for 10 days only. worst case Oct 11th 2008. I am with same employer whom I was before ext. Should I go for renewal of stamp in india ? I know PIMS may hold me there for a long time.

Can I travel if visa is going to expire in 2 weeks. but having ext approved ?

Can i eligible for emergency appointment worst case ?

What if they put me on hold under PIMS ? will they hold passport ? or I can travel with old valid visa ?

Please reply urgent . My law firm has not answered my email yet and I may have to buy ticket and fly this weekend..

cchaitu07-18 03:40 PMI don't think you are right for first question. AC21 can be invoked if you have applied 485 more than 180 days. Why EAD is related here. You can change the job after 180 days by transferring your H1 to new company. This is the information I have but it is better to verify it from a lawyer.

Can I join new company on my EAD after 180 days of I485 receipt date??

One quick question:
What is AC21 provision: is this a clause or any other application or ????

You cannot start working until you have an H1B stamp. make sure you have a valid visa to come back to USA if H1B stamping is denied at canada or mexico assuming you are not canadian or mexican, else you would need to fly back to home country to get a stamp, directly from Canada or Mexico.

This forum is full of smart people. So I want to throw my situation out there to get some advice from all of you. I am into 7th year of my H1 with by labor with PD of Sep 2002. At the rate things are moving, I am running out of patience here.

Things took an interesting turn last week, when a mid sized Software co. is willing to outsource me some of their work. Given the size of the opportunity, I will need to go to India to setup a team of 5 to 6 ppl. The co. is pretty eager and willing to offer some of the finanical guarantees I have asked for.

So my question is, should I take this opportunity and say good bye to GC? Or I should be patient as there may be a need to be in US to grow my outsourcing biz, in case it jump starts well. What would you do if you were presented this opportunity and you had the enterpreurial spirits to pull it off.

I would be eager to see what people say here.

Guess the smart people here are going to say: go back and reduce the queue. Just kidding:)
