wandmaker07-14 04:42 PMI have 140 approval notice in mail like 1.5yrs back...just today i put the reciept number on USCIS website and it says still pending..i called USCIS and they say they wont be able to discuss my case since 140 is employer specific only....my employer is sayin dont worry and dont bother about online status...i just want to make sure my 140 is really approved and USCIS has the correct update while lookin at my 485 file...i dont want them to put my 485 in hold just because of they thinkin 140 is not approved...

As long as you have approval copy on hand, you have nothing to worry. You should be concerned only if the status reads as 'case reopened and pending'

If one sends a package and somehow it does not get delivered for 14 days, USCIS cannot mark the application received until and when it receives it, period.
Please check before posting untrue statements. So even if your application reaches the uscis on the July 3rd, but uscis enters your application to the system on August 1st, your filed date will be July 3rd. So don't worry. Make sure your package reaches USCIS in July and you will be OK.

gc_user11-27 09:29 PMMy husband has a unique experience with his I 485.My husband's employer filed I 131 ,I 485 for my husband and I 131,I 485 and I 765 for me on august 16.I recieved my receipts on october 16 and got my EAD approved on November 16. My husband didn't receive even receipt notices.

When he called UCSIS and checked on his status with level 2 officer, they told that they did not have any info on I485 but voided his I 131 application. He is planning on reapplying for I485.

Is there any downside of reapplying it as our priority date is september 2003(EB2).

Now I have two H1Bs after transfer, literally. Am I correct? Now I am eligible to work for both the companies. Am I correct?
Hi Raja, you hve it wrong. You dont have two visas its considered as only one. You have transfered your existing VISA to another employer. An H1 transfer is just change of employer for that given visa.

So if you are working with two companies at the same times its considered illegal. But you can work partime with your existing company A, ask the company B to approach your company and work on C2C. But dont forget to update USCIS on your parttime work.

I need a clarification about the I-94 thing.

As I have mentioned previously, my husband got a 3 year extension on his H-1 ( I 140 approval ) till 08/2009 and he went to canada for stamping since we are planning to leave for India. He drove to canada and the officers at the border while entering into canada did not take his old I 94( expired 08/2006) which was on his older passport ( expired 04/2006). While on his way back to US, they stapled the lower part of his I-797 dated till 08/2009 to his new passport (current one) and stamped on the passport. But they did not put any date on the stamp where it shows'dated till'.

We are leaving for India tomorrow and have a couple of questions in this regard:
1. Is it okay to have two I 94's in the two different passpots? Has it happened to anyone who drove to canada that their older I 94 has not been taken?

2. While departing to India, which I-94 will be taken? the expired one on the older passport or the new one in the new passport. If the new one has to be taken, as it is a part of the original I-797 form, should it be surrendered to them?

We really appreciate your answers. Since we are travelling tomorrow, we are really concerned about this issue.

2. if I plan to visit india after H1b aproval, do I need to get a new visa stamping for company B or can I travel back with company A visa ..??

I got a new stamping before i came back to US. But while my application was pending, i called US Consulate in India they said you don't need one as long as current stamping on passport is valid. They said you just need to show new company's appointment/employment letter at immigration if questioned. But better to check with attorney, my attorney asked me to get stamped and come back

3. For me to travel back with company A visa , do I need to make sure company A has not informed USCICS to cancel H1b visa.

I think yes. I would suggest to have a premium h1 transfer so that you have new papers in 15 days and you don't depend on your old company's visa

You can reply to the RFE exactly as you stated. That your wife and child are abroad and will be applying for visas at the U.S. post to accompany you, therefore they do not have A numbers or receipt numbers.

You must file I-824s for them if you have not already done so.

You mean photocopy right? If you have scanned copy then print it and send it to USCIS. I don't think they require it in original.

I went through the same and it was fairly easy and not stressing.. you have to have copies of your passport ( the persons applying for extension and copies of the return tickets of the flights back home, you need a form : I-539 and fill it up, print it and send it with all the documentation they require, it would be advisable to have a sponsor or a person who certifies that will be financially in care of her expenses. ( forgot the form number but i think is I-139 ..please check ) and once you got all those requirements send them with 300 $ that costs the application process and in less then 4 weeks you will get a letter with either the aproval or the denial of the stay. If your I-94 expires while you wait for the form do not worry cause you are not going into illegal state while the USICIS is processing your application. GOOD LUCK !! and enjoy your ceremony !!

bpratap02-19 04:41 PMgot to the SSN office with ur receipt, tell them you are waiting for ...... long for the card. you need the number to give to the employer. most of the officers would look in the system and would give you the number.
