so basically you need to go for stamping to the local consulate for the visa.

If you apply from outside and then come back before it is approved using your old H1 , you would probably get an approved H1 without I-94 which would would need to get stamped again before your current one expires.

Therefore I would suggest that you come back and apply from US itself so that you don't have to go back for stamping again.

1) can i include her even thought she is on OPT, will that effect our I-485 approval as she is a non-immigrant status
2) should be convert back to H4

I got laidoff recently. My company is going to withdraw H1b. I have my 140 approved from same company and my 485 pending. I have EAD and never used and working on H1B for the same company. I was working for the same company which processed my H1B.

If H1B is withdrawn is there going to be any effect on my 485? like any possibility of RFE on 485 for EVL? My employer said they will not withdraw or revoke 140.

How long will it take to withdraw H1B?

My check for 485 was cashed on August 20 (process by my bank) and the online case status says receipt was mailed out. But my lawyer has not received it as of today.

fiestagirl05-28 06:00 AMI have searched the internet on this and had no luck.. i'm 20 weeks pregnant and Canadian married to a USC. I went for my medical today and had all of my backup for vaccinations / immunity but the immigration doctor wants me to get a tetanus shot. All information on the web says this is "safe" during pregnancy, however I am completely opposed to having a vaccination while pregnant or breast-feeding due to potential issues vaccinations can cause (eg: autism in children). While this is not readily "accepted" by the medical community, it is how I feel. Some very high profile people have talked about vaccinations and the dangers they can cause but the medical community seems to reject their logic (not enough studies.. who knows).

I don't feel that I should be subjected to this when I'm so opposed to it - I know I can apply for a "moral objection" but I can't find any information as to whether USCIS actually acknowledges these objections.

Has anyone out there been in a similar situation or know of how I can get an exemption from this during my pregnancy / breast-feeding stage?

This is not true. People in AOS can apply for unemployment benefits. Unemployment benefits are paid by employers and all you need is an A number to get it.
