Both degrees are from a US university.

I want to know how this can be possible. A few folks who work with me claim that some folks whom they know well have got GC in Feb 2007, even though there PD is June 2005.

They are all from India. I am sitting here with Aug 2001 PD, just cleard from BEC and waiting to file 140 and 485.

Do you think there is any truth to the previous statements of my friend ?

raysaikat03-03 01:28 AMAs far as I know employer sponsorship is not required for EB-1 EA case; not sure why you had to file I-140 for this ...........

EB-1 EA does not need labor certification, but still needs I-140.

fionaapple2011-27 01:05 PMHello, I have read about the 485 180 days rule and how one can use AC21 after 180 days have elapsed. But if one loses their job a 2 mths before the 180 days are over, is there a possibility of continuing the 485?

- Can one be unemployed and just wait out the 180 days before invoking AC21?
- Can one transfer to another employer on H1 (but let USCIS know after 180 days have elapsed)?

I have been working for company X on an H1-B.

* They filed for an EB-3 Labor Certification (RIR) and I-140 with a priority date of April 2003 on my behalf.

* My H1-B expired in March 2006 and they filed for a 3-year extension, which was approved (till March 2009).

* In the meantime, both my Labor and I-140 were approved. I had been waiting to apply for my I-485 since then.

* Now, I'm switching employers (because of a RIF in company X) to company Y, who were working on making me an offer.

* However, company Y's legal department came back saying that they cannot apply for an H1-B transfer because the current law doesn't allow transfers from an H1-B extension (after the original 6-year H1-B has expired).

Could somebody advise me if this is really true?

I've an appointment in October at Munich, Germany consulate for H1B stamping. Because of time constraints I decided to get the stamping done when I'm out there for work. I've already obtained the german visa (though had to provide plenty of explanation !). This is my 9th yr extn (MS, EB2 - 140 approved)

- Can anyone share their experience at the Munich consulate?
- or, should I plan going to Canada and trying rather taking the risk in Germany?

I was on regular H1B for three years until mid 2008 when I changed to H4 status. Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??

You can apply for change of status (COS) from H4 to H1 at any time of the year, if your employer is cap exempt (non-profit) and you have not completed 6 years of maximum stay on H1B/L1. You will not be counted again in cap, so you can return to for-profit employer at any time provided you have not completed 6 years of maximum stay in H1/L1. In order to stay on H1 beyond 6 years, you need to have a labor pending for more than 365 days or 140 approved.

Almost everybody renewed EAD/AP by themselves.
EAD/AP filings must go to your I-485 processing center.
I think, if the lawyer send to wrong center, it will redirect to the correct center, there will be a time delay for this.

My lawyer sent my wife EAD renewal papers to VSC.

Our cases at at TSC presently. I asked him to sent it to TSC but he said since the original EAD / AP were approved by VSC the renewal has to also go to VSC.


I am not sure what is going to happen. I have not seen my cheques cashed nor have received the package back?

FedEx trackinh number says it was received at VSC on July 10.


Can anybody shed some light whats going to happen next ?????

roseball09-16 02:21 AMYou can get your EB3 PD. Your lawer needs to write to the USCIS to port your PD. Attorney here would give you more details and wait for them to respond.

The OP cannot port his EB-3 PD in this case as his EB-3 I-140 was not filed/approved. One can only port an older PD if they have an approved I-140 with old PD. Just an approved LC with old PD won't help.

Internally, NSC or TSC will get ask for confirmation of your labor from DOL. Most of the times there are no issues. The biggest factor to begin with is that instead of being able to do Premium processing and get your 140 in 15 days, now you are looking at a period of 4-8 months in normal processing and there is nothing you can do to speed up the process.

AabTuAgaGC06-19 09:56 AMI gues with iin 2 months for AP. but i don't know in current scenario with lot of applications. There is no harm in filing AP & EAD with 485. Even if you get them you can use it or not choice is yours. but if you use EAD h1/H4 will be invalid and you have to come back in AP. Also if you come in AP then your H1/h4 will be invalid you have to use EAD.

I think 4-5 months is decent time to get AP. But with current volume I am not sure.

I don't think traveling back on AP invalids your H1. I checked with my lawyer and this is what he told me.
